Section and of the Act on Counteracting Unfair Practices states respectively that An unfair market practice is the application of a code of good practice, the provisions of which are contrary to the law. An unfair market practice is committed by the creator of the code of good practices, the provisions of which are contrary to the law. The cited regulations undoubtedly sanction both the application of the code of good practices. The provisions of which are contrary to the law, and the actions of the creator of such a code. The above position is confirmed in the judgment of the Supreme Court of April. Which found that the content of the provisions of the Act of August on counteracting unfair market practices clearly shows that the will of the national legislator was to include the creators of codes of good practice within the scope of application of the Act. Determination of inconsistency of Art. section of this Act with Art. section sentences of Directive therefore does not prevent the application of this provision to assess the entrepreneur's behavior in connection with the general clause of the Act on Counteracting Unfair Market Practices.
